The the U.S. Supreme Court Declared the Tomato to be a "Vegetable"

WASHINTON, May 10, 1893

Back in 1893, a group of guys were importing tomatoes into the USA from the West Indies. Now at the time, there was a 10% tax on vegetables but no tax on fruit.

The tax collectors made the tomato-importers pay the tax.

Because they have seeds, tomatoes are considerd to be a fruit by plant scientists. So the guys importing the tomatoes sued the government to get the money back because the tomato is a fruit and not a vegetable.

The case ended up going to the Supreme Court. Justice Gray ruled that because tomatoes where known as vegetables and used as vegetables, that's what they were... vegetables!

Case closed!
